This volume contains the Final Award of the Arbitral Tribunal established to decide a dispute between Ireland and the United Kingdom under the 1992 ’OSPAR’ Convention for the Protection of the Marine Environment of the North-East Atlantic. The dispute concerned the commissioning by the UK of a mixed oxide fuel plant at the Sellafield nuclear facility. Ireland sought access under Article 9 of the Convention to certain information deleted from published reports that were prepared as part of the approval process. The UK declined the request on the basis that the information was withheld on commercial confidentiality grounds. This volume contains the award of the arbitral tribunal, with a commentary on its contribution to international law by Professor Daniel Bodansky.
